Genesee Sun – "The Livingston County Sheriff’s Office arrested three people on felony drug charges after a passenger allegedly threw a crack pipe from the window of a pickup, but they say the District Attorney’s Office later filed a different charge.
According to a press release from Livingston County Sheriff Thomas Dougherty, arrested were: Gerald Phelps, 61, of Mount Morris; Daniel Cooke, 39, of Dansville; and William Clevenger, 35, of Mount Morris.
On July 13, Deputy Mike Wade and Deputy Jerry Pilkenton were assigned to the Operation Safe Interstate Initiative. While patrolling Interstate 390 in the Town of Geneseo, they were following a pickup truck and observed a passenger throw something out of the pickup as it was traveling down the road.
The Deputy Sheriffs stopped the vehicle and the driver as Phelps, one passenger as Cooke and the passenger who allegedly threw the object as Clevenger.
While Deputy Wade was interviewing the occupants of the pickup, Deputy Pilkenton was able to find what was thrown from the truck. The object he located is alleged to be a glass pipe commonly used to smoke crack cocaine.
Further investigation found what is believed to be nearly 2 grams of crack cocaine in the pickup. This led to all three occupants being arrested for felony Criminal Possession of a Controlled Substance in the Fifth Degree. Clevenger was also charged with Littering.
Deputy Rick Gage also assisted on scene.
Phelps, Clevenger, and Cooke were all taken to the Livingston County Jail and turned over to Central Booking Deputies for processing and pre-arraignment detention. The District Attorney’s Office was contacted and recommended that bail for each be set at $2,500 cash or $5,000 bond.
Geneseo Town Justice Kathleen Houston arraigned the three defendants. According to the Sheriff’s Office’s press release, the District Attorney’s Office presented the court with a Prosecutors Information charging the defendants with misdemeanor Criminal Possession of a Controlled Substance in the Seventh Degree, and the defendants were arraigned on that charge.
The judge set bail on all three defendants at $1,500 cash or $3,000 bond."
