13 WHAM - "It's back to jail for Judge Leticia Astacio.
Astacio was back in Monroe County Court Wednesday afternoon for a briefing hearing about the status of her bail.
Earlier this week, Judge Stephen Aronson ordered her held without bail until next month's hearing on allegations she repeatedly violated her probation.
On Wednesday, Judge William Kocher denied the request to have bail set Wednesday, saying bail doesn't apply in this case. He said Astacio's attorney needs to file a different type of motion in State Supreme Court because he does not have the authority to approve this motion.
Judge Kocher subsequently denied the bail application and remanded Astacio back to the Livingston County Jail where she was being held previously.
Gregory Salmon, Astacio's attorney, will file new papers before 5 p.m. Wednesday. If the paperwork is filed and approved for a new bail application in State Supreme Court, Astacio could return to court as early as Thursday.
Astacio will be held in jail until November 3 - the day she answers to allegations that she repeatedly violated her probation.
There are seven alleged violations in total, running from July until October.
