13 WHAM - "A Rochester man is charged with criminally negligent homicide, accused of selling heroin to a man shortly before he died of a drug overdose.
Gates police say 26-year-old Brian Saez sold heroin to 33-year-old Sean Vaniderstine of Gates about one hour before his death in January."
"Saez he currently on parole for DWI. Police say he has four previous felony convictions, two of them were for drug offenses.
Saez is also charged with criminal possession of a controlled substance in the 3rd degree, and criminal sale of a controlled substance in the 3rd degree.
Police also arrested 34-year-old Darnell Tillmon of Greece in connection to the same case.
Police say Tillmon may have previously sold heroin to Sean. He is charged with criminal possession of a controlled substance in the 3rd degree, and criminal sale of a controlled substance in the 3rd degree.
At the time of his arrest, police say Tillmon was in possession of 10 individual packets of heroin.
Further potential homicide charges relating to the death of Vaniderstine will be pursued once the toxicology results are completed by the Monroe County Medical Examiner’s Office which could take an additional 6 months."
