A violation of probation charge against Judge Leticia Astacio has been dismissed. The charge stems from an alleged incident in Henrietta. Astacio was accused of trying to purchase a shotgun. Ontario County prosecutor Zach Maurer said the charge has been withdrawn without prejudice. A felony weapons charge in relation to the alleged incident was waived to a grand jury last month. Maurer said the violation of probation charge may be reinstated if the grand jury decides to indict Astacio. The New York State Commission on Judicial Conduct filed a lengthy argument earlier this week laying out its reasoning for why it believes Astacio should be removed from the bench. She is expected to appeal the commission's recommendation in September.
