Livingston County was served with a notice of claim Monday in connection with the death of a man who was in police custody. The family of Noel Colon is accusing authorities of gross negligence and wrongful death. Colon was arrested on November 3 on charges including driving while ability impaired by drugs and criminal possession of a hypodermic instrument. Deputies said Colon was held in pre-arraignment detention, but was found unresponsive and not breathing. He could not be revived.
